Motions to Determine the Court that Will Try and Decide the Case
If a case falls within the jurisdiction of the Czech courts, but the conditions of local jurisdiction are not fulfilled or cannot be determined, the Supreme Court determines which court will hear and decide the case [Sec. 11(3) of the CCP]. In practice, this applies in particular to cases where the defendant (or the obliged in enforcement proceedings) has no place of residence in the Czech Republic.
