Removal and Transfer of a Case

If the competent court cannot hear the case because its judges are recused, the case must be transferred to another court of the same instance; the case may also be transferred to another court of the same instance if it appears appropriate (Section 12 of the CCP). The Supreme Court decides on a removal and transfer of a case between the high courts or between the regional courts or district courts if each of these courts falls within the jurisdiction of a different high court. The court fee in the case of a motion on grounds of appropriateness is 1 000 CZK.
